A woman from Edison says she was called a "Karen" and other names while on line at a ride and iPlay America did nothing about it. The indoor theme park is in Freehold. The 55 year old was there for a child's birthday party. The incident happened when park employees mistakenly told her she could not ride the go karts. While she argued with the employees about their decision. The line for the ride was held up. Some of the children on the line started to taunt her in front of her two young children. She felt she was entitled to some kind of compensation because park employees did nothing to stop them. The lawsuit said she was embarrassed and humiliated and felt discriminated against." Especially since her small children were present.
The Appeals Court ruled that iPlay America's responsibility to keep guests safe does not extend to "derogatory" comments. The court said: "Preventing certain communications between patrons is not feasible." You can't sue for getting your feelings hurt.
In other words sticks and stones can break my bones but names can never hurt me.
